Artwork
The site displays paintings, sculptures in gallery and shop section. Each of these are accurately described with details such as size, medium etc. authentically, when put up for sale. Works have been photographed and uploaded without any editing with reference to color, saturation etc. Variations in appearance of the original if any may be only due to the variations in ambience of light.
Pricing and Payment
Prices are mentioned in Indian Rupee. The price includes GST and delivery with in India and exclusive of the cost of shipping as it may vary depending on the country and the logistic handlers. The same will be informed to the buyer. Sale is deemed complete on receipt of the payment for price and shipping cost for overseas delivery. The corporate buyers shall mention the need for GST billing. We will be happy to provide the same as we are GST registered as per Act in force in India.
Ownership and copyright
The buyer will be the happy physical owner of the art work but not the reproduction right of the original work. The artist retains the right to keep a copy, reproduce prints and sell.
Liability
We are not liable for loss/ damage caused by incorrect handling of the art work after proper delivery in good condition.
General
The architecture color scheme and contents are the exclusive property of the site owner. Copying and duplication of the content amounts to violation of patent and copy right legislation. Any general visitor to the site complies to this condition by deeming provision.
Plagiarism
The works of the artist displayed and put up for sale are the original ideas and works of the artist. The contention as to plagiarism is the commonest globally. While the visitors to the site can trust on the works displayed here to be free from plagiarism, they are advised to exercise due caution of their own under caveat emptor to avoid any future litigation. The onus of proof of plagiarism rests on the person who contend it.
Translation and interpretation
The terms and conditions may be translated in any language for the purpose of customers convenience, but, interpretation of the same in English will hold good for any legal purpose.
Severability and waiver
Severability: If any provision of these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objective of such provision to the greatest extent possible under applicable law and the remaining provision will continue in full force and effect.
Waiver: Except as provided herein, the failure to exercise a right or to require performance of an obligation under these terms shall not affect a party’s ability to exercise such a right or require such performance at any time thereafter nor shall the waiver of such breach constitute a waiver of any subsequent breach
Dispute resolution
Any dispute shall be subject to courts in Madurai, Tamil Nadu, South India.
Reservation:
The owner of the site reserves right to change, add, or delete any term or condition without prior intimation. The change is deemed coming to effect on the date and time of its update.
